Your Leave Entitlements Under the ESA
Under the Employment Standards Act (ESA):
- Pregnancy leave: Up to 17 weeks (for the birth parent)
- Parental leave: Up to 61 weeks for birth parents, 63 weeks for non-birth parents
- Combined maximum: Up to 78 weeks of job-protected leave
What Employers Cannot Do
Your employer cannot:
- Terminate or lay you off because you're pregnant or on leave
- Demote you or reduce your pay upon return
- Pressure you to return before your leave ends
- Penalize you for taking job-protected leave
EI Benefits and Top-Up Payments
While on leave, you may be entitled to Employment Insurance (EI) maternity and parental benefits. Some employers also offer top-up pay as part of their benefits package — check your employment contract or HR policy.
What to Do If Your Rights Are Violated
If you were fired, demoted, or treated unfairly because of your pregnancy or parental leave, you may have a claim for wrongful dismissal or Human Rights Code discrimination.
